1.1 The Komo Affiliate Program ("Program") is designed to enable content creators to earn commission by promoting Komo's services through social media content creation.
1.2 By participating in the Program, you ("Affiliate") agree to abide by these Terms of Service ("Terms").
2. Eligibility Criteria
2.1 The Program is open to individuals worldwide who have their own social media presence.
2.2 There are no restrictions on age, location, or subscription status.
2.3 Affiliates must have their own personal social media account on at least one of the following platforms: TikTok, Instagram, or Twitter (X).
2.4 To maintain the integrity of the Program and ensure genuine engagement: a) Participating social media accounts should demonstrate a history of authentic activity. b) Accounts primarily used for promotional purposes or those exhibiting unusual patterns of activity may not be eligible. c) Komo reserves the right to determine eligibility at its discretion and may request additional information if needed.
3. Content Creation Requirements
3.1 Affiliates must create and post content on their personal social media platform.
3.2 All posts must tag the relevant Komo social media account and include the hashtag #komoai.
3.3 Content must be factual, respectful, and engaging. If unsure about content appropriateness, Affiliates should consult Komo for guidance.
4. Program Entry Process
4.1 To participate in the Program:
a) Signup on komo.tolt.io and get approval from the team
b) Create and share content on eligible platforms (TikTok, Instagram, or Twitter)
c) Tag Komo's account and use #komoai
5. Commission Structure
5.1 Affiliates earn 30% commission on revenue from new customers they refer to Komo.
5.2 Commission period extends for the first 12 months of the referred customer's subscription.
5.3 Payments are processed monthly via PayPal and Tolt.
5.4 Komo reserves the right to modify the commission structure with appropriate notice to Affiliates.
6. Content Ownership and Usage Rights
6.1 Affiliates retain ownership of their content.
6.2 By participating, Affiliates grant Komo permission to share their content on Komo's social media platforms and website.
7. Privacy and Data Protection
7.1 Personal data collected will be used solely for Program purposes and protected in accordance with applicable privacy laws.
7.2 Affiliates must provide basic contact information and social media handles, which will be securely stored and not shared with third parties.
8. Compliance and Legal Obligations
8.1 Affiliates must comply with all relevant legal obligations, including FTC guidelines on endorsements and intellectual property laws.
8.2 Affiliates agree to indemnify Komo against any claims arising from their participation in the Program.
9. Tax Liability
9.1 Affiliates are responsible for any tax obligations arising from the receipt of prizes or rewards.
9.2 Komo will provide necessary documentation for tax reporting purposes if required by law.
10. Limitation of Liability
10.1 Komo is not liable for any direct, indirect, incidental, or consequential damages arising from participation in the Program.
10.2 Affiliates agree to release and hold harmless Komo, its affiliates, employees, and agents from any claims, damages, or liabilities arising from their participation.
11. Program Modifications
11.1 Komo reserves the right to modify, suspend, or terminate the Program at any time, for any reason, without prior notice.
11.2 In the event of program changes, Komo will not be liable for any damages or losses incurred by Affiliates.
12. Intellectual Property
12.1 Any materials provided by Komo to Affiliates remain the intellectual property of Komo.
12.2 Affiliates are granted a limited, non-exclusive license to use such materials solely for Program participation.
13. Dispute Resolution
13.1 Any disputes between Affiliates and Komo will be resolved through mediation or arbitration.
13.2 These Terms are governed by the laws of the jurisdiction in which Komo is headquartered.
14. Severability
14.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Acceptance of Terms
15.1 By participating in the Komo Affiliates Program, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
